The latter gives us an opportunity to buy some attractive players, and I want to reiterate that two are very exciting because expectations are low: Yum! Brands (YUM) and Panera (PNRA). Panera CEO Ron Shaich came on my show recently and made it clear to me that they have lowered expectations to the point that I am not worried that they will miss, especially with the lower oil prices.

First, let me say that of the ones that are overly shorted, I like Ethan Allen (ETH), Sears (SHLD), Bankrate (RATE) and Panera (PNRA), all profitable, all either doing well or could turn, and all do well if the housing market turns.

Shamrock Activist Value Fund cut its stake to 943,710 Class A common shares (3.25%), by selling 405,662 from July 22 to Aug. 18 at $50.03 to $55.09 each.

I believe the best restaurant chains that are not fast food, notably Darden (DRI) and Panera (PNRA), can be bought, but you are going to have a lag between the pump's decline and now, and that will make these much more dicey. Brinker (EAT) just reported a decent number, add that to the list. I would love to buy Yum! Brands (YUM), but the commodity lag won't let them have a good quarter, although they have already tempered expectations.

Shamrock Activist Value Fund believes the company has "governance deficiencies." Shamrock suggested that the bakery-cafe chain adopt a majority-voting standard for electing directors, replace its staggered board system with annual election of all directors, and convert outstanding shares of multiple-vote Class B common shares into Class A, so that all common shares have the same voting rights. Shamrock said it has had and will have discussions with the company's senior managers and directors on ways to enhance stockholder value. Shamrock owns 1,349,372 shares (4.67% of the total outstanding).

Great Swing Trade

Panera Bread (PNRA) was upgraded from Neutral to Buy at PiperJaffray. $62 price target. There is potential for Panera to lock in favorable wheat prices and expectation for increased operating leverage translating into increased earnings potential.
